The State of California filed a lawsuit against one of the world’s leading soda company ’’ Pepsi’’,  for disregarding to issue out a warning that its soda contain 4-Mel which  is short for 4-Methymlimidazole, a heterocyclic organic chemical compound that is formed in the manufacturing of caramel colouring, a substance officially recognized as a cancer-causing chemical.

The lawsuit began to brew in 2013 when the Center for Environmental Health, California brought out test results which showed that Pepsi purposely covered up the presence of high level of 4-Mel in its soda drinks, nevertheless Pepsi denied this claims and has since failed to put a label on Pepsi drink including Diet Pepsi and Pepsi one, to warn the public stating that the drinks contain 4-Mel chemical.

More so, in 2014 the  Consumer reports test reported that 4-Mel chemical in Pepsi was way more than the level of 29 micrograms of 4-Mel which is permitted in a bottle or can of drink, which violates consumer protection statutes and the proposition 65 in the state of California , which mandates manufacturers to provide the consumers warnings of if their products exposes them to risk of  ingesting cancer-causing compounds.

This limit was put in place by the state’s Office of Environmental Health Hazard Assessment because pass the level of 29 micrograms of 4-Mel induces the risk of cancer of one in 100,000 persons in the society.

Pepsi has constantly fought off each of this reports, claiming that due to the fact that the state’s proposition 65 indicates to exposure per day rather than exposure per can and that the average amount of drinks it’s consumers consume each day is less than a can there is no need to place warnings on the drinks.

However, now a settlement lawsuit against Pepsi has gained approval from a federal judge in California and part of it requires Pepsi to ensure reduction in the level of 4-Mel inclusion in its drinks, and not exceed 100 parts per billion in products that are being shipped for sale in the U.S , and will also be tested using specific protocols all of which’’ Pepsi’’ has agreed to.
