The Managing Director of the Kano State Traffic Agency, KAROTA, Baffa Danagundi, risks arrest over alleged assault on a commercial tricycle rider, Mujtaba Isah.
A Chief Magistrate Court presided by Ibrahim Khalil had previously ordered police to investigate the complaint of assault causing a fracture to the tricycle operator but discontinued.
The court, instead, ordered criminal summons be served on the Managing Director. The court will deliver a ruling on the application for service by substituted means.
The complainant, Isah, a commercial tricycle operator, came to court with his father to observe proceedings.
Danagundi, who is the defendant in the matter, was not in court, neither was he represented by a lawyer.
Counsel for the complainant, Abba Hikima, told the court that the bailiff of the court was denied entry to the office of the defendant to serve him with a court summons.
The Chief Magistrate told the lawyer that the defendent had filed a Preliminary Objection to the suit.
Counsel for the complainant, however, argued that his Preliminary Objection could not be taken since he refused to be served with a court summons and was not personally in court.
Hikima urged the court to grant leave for service by substituted means relying on sections 138 and 139 of the Administration of Criminal Justice Act.
The court adjourned to Wednesday, March 24th for ruling on the application for service by substituted means.
