Mailafia moves to stop DSS and police “harassment”

A Plateau State High Court sitting in Jos has adjourned to September 29 for ruling on applications of abuse of fundamental human rights filed by former Deputy Governor of the Central Bank of Nigeria, CBN, Dr. Obadiah Mailafia, against the Nigeria Police, Department of State Services, DSS, and the Federal Republic of Nigeria over constant harassment and invitation for interrogation.

When the matter came up for hearing before Justice Musa Ashoms, counsel to the plaintiff, Pius Okubo, SAN, told the Court that the invitations of his client by the Nigeria Police Force and the DSS are threats to his fundamental rights.

He explained that the grounds of the application are that Dr. Mailafia has already been invited by the DSS in furtherance to the viral video on the brutal killings in North-Central Nigeria and the world.

Akubo said the applicant in the matter is already a subject of an investigation by the DSS and the fact that the matter is already under investigation is enough.

However, Counsel to the 1st, 2nd, and 3rd defendants, Lukman Fagbemi, explained that the applicant came to court touching on the internal security of the country seeking the court to protect his fundamental right.

He stated that the Nigerian Police are on the right path to have invited Mailafiya for investigation.

Fagbemi added that except the Nigeria Police indicate that they have an ulterior motive which is under Section 4 of the Police Act, it is very clear they can carry out investigation within and outside Nigeria and urged the court to dismiss the plaintiff’s application

After listening to both arguments, Justice Ashoms then adjourned the matter to September 29 for ruling.
